On 17 December 2013 the European Court of Human Rights had ruled by five votes to two that Switzerland had violated the right to freedom of expression by convicting Doğu Perinçek, chairman of the Turkish Workers’ Party, for publicly denying the existence of the genocide against the Armenian people (see our blogs on Strasbourg Observers and ECHR-Blog, 7 and 8 January 2014). The Grand Chamber has now, on 15 October 2015, in a 128 page judgment, confirmed, by ten votes to seven, the finding of a violation of Article 10 ECHR.

Today, judges ruled that Switzerland did breach human rights law in taking legal action against a Turkish politician who publicly denied that the Ottoman Empire had committed genocide against the Armenian people in 1915.

 

In its Grand Chamber judgment in the case of Perinçek v. Switzerland (application no. 27510/08) the European Court of Human Rights held, by a majority, that there had been: a violation of Article 10 (freedom of expression) of the European Convention on Human Rights.

On 6 October 2015, the Court of Justice of the European Union (ECJ) declared that the Safe Harbour agreement which allowed the movement of digital data between the EU and the US was invalid. The Court was ruling in a case brought by Max Schrems, an Austrian student and privacy campaigner who, in the wake of the Snowden revelations of mass surveillance, contested the fact that data about Europeans and others was being stored in the US by tech companies such as Facebook.
